This policy describes how Elizabeth Reale Modelling, trading as Moi Models (“Moi Models” or “we”), processes personal data in connection with the moimodels.com website, with applications and with the agency’s services.
The processing is governed by the Swiss Federal Act on Data Protection (“FADP”) and, in cases where the conditions for its application are met, by Regulation (EU) 2016/679 (“GDPR”).

2. Personal data processed
Depending on how you interact with us, we may process:
- Contact and correspondence data: name, email address, telephone number, the content of enquiries and any attachments.
- Application data: date of birth, city and country, height and body measurements, professional experience, photographs, polaroids and other materials provided for the assessment of the profile.
- Parent or legal representative data: contact information and documentation relating to the authorisations required for applications from minors.
- Casting database data: information and materials from the application that you choose to make available for future opportunities by means of a specific consent.
- Contractual and administrative data: information necessary for the management of representation, bookings, contracts, payments and invoicing.
- Technical data: IP address, browser and device information, the date and time of requests and the logs necessary for the operation and security of the website.
- Browsing data: page and profile view events and interactions with the contact buttons, in the manner described in the Cookie Policy.
We normally collect the data directly from you. For the management of our services we may also receive information from your legal representative or from clients involved in a specific assignment.
We ask you not to send health information or other particularly sensitive data that is not necessary for the assessment of the application. Should such information prove necessary for a specific purpose, we will provide the relevant information on the processing and identify the applicable legal grounds before collecting it.
3. Purposes and grounds for processing
We process personal data for the following purposes.
Responding to enquiries. We use contact data and the content of messages in order to reply and to manage correspondence. Where the GDPR applies, the processing is based on Article 6(1)(b), for pre-contractual measures requested by the data subject, or on Article 6(1)(f), for the legitimate interest in handling the other enquiries received.
Assessing applications. We use the information and materials submitted in order to review the profile and to assess a possible representation relationship. Where the GDPR applies, the processing necessary for that assessment is based on Article 6(1)(b).
Managing representation, contracts and bookings. We process the data necessary to organise and perform the agreed services and to handle the related administrative obligations. Where the GDPR applies, the processing necessary for the performance of the contract is based on Article 6(1)(b). Mandatory obligations are fulfilled in accordance with the applicable statutory provisions; Article 6(1)(c) GDPR is relied upon where the conditions for it are met.
Ensuring the operation and security of the website. We use technical data in order to provide the website, detect malfunctions and counter unauthorised access. Where the GDPR applies, the processing is based on Article 6(1)(f), for the legitimate interest in keeping the website secure and operational.
Managing the optional casting database. With your consent we may retain the profile and the materials submitted in order to assess future casting and booking opportunities and to disclose the relevant materials to selected clients for specific projects. Where the GDPR applies, the processing is based on Article 6(1)(a).
Under the FADP, we process data in compliance with the applicable principles, including good faith, proportionality, transparency, purpose limitation and security. Where a justification is required under the FADP, it must arise from consent, from an overriding private or public interest, or from the law.
4. Provision of data and casting database
The data necessary to handle an enquiry or to assess an application is indicated in the relevant form. If it is not provided, we may be unable to reply, to assess the profile or to provide the requested service.
Inclusion in the casting database is optional. Refusal or withdrawal of the related consent does not affect the assessment of the application for possible representation.
Inclusion in the database does not constitute representation by Moi Models, does not entail exclusivity and does not guarantee that assignments will be awarded.
Consent to the database concerns the assessment for future opportunities and the disclosure of the relevant materials to selected clients. It does not in itself constitute authorisation to publish images on the website, on social media or in advertising campaigns. Such uses are the subject of specific agreements or authorisations.
5. Recipients of the data
Within Moi Models, the data is accessible to the persons who need it in order to carry out their respective activities.
Where necessary, it may be disclosed to:
- providers of IT, hosting, email and data management services;
- Exxentia, in Italy, for the management of the moi.app application;
- Vercel Inc., in the United States, for services relating to the website;
- clients involved in a booking or, for those registered in the casting database, selected clients interested in a specific project;
- authorities and other recipients where disclosure is required by law.
Providers that process data on our behalf operate on the basis of the agreements required by the applicable legislation. Clients may act as independent controllers for the processing carried out under their own responsibility.
We disclose to clients only the information and materials relevant to the assessment of the profile or to the management of the assignment.
6. Processing and transfers abroad
Data may be processed in Switzerland, in Italy and in the United States within the scope of the services described in this policy.
Transfers are subject to the conditions laid down by the FADP and, where applicable, by the GDPR. Depending on the recipient and on the transfer, those conditions may be met through the recognition of an adequate level of protection or through appropriate safeguards, such as standard contractual clauses and, where necessary, supplementary measures.
Any reliance on the Data Privacy Framework presupposes that the recipient holds a valid certification for the framework applicable to the transfer: EU–U.S. or Swiss–U.S.

7. Retention
We retain data for as long as is necessary for the purposes for which it was collected, according to the following criteria:
- Enquiries: up to 24 months from the last interaction, unless the correspondence is necessary for the management of a contractual relationship.
- Applications: up to 12 months from the last contact relating to the assessment. If a representation relationship is established, the necessary data is retained for the management of that relationship.
- Casting database: up to 24 months from the giving of consent, unless it is withdrawn earlier. Before expiry we may ask for a new confirmation in order to continue retention. In the absence of confirmation, the profile is removed from the database.
- Accounting records: for the period prescribed by the applicable legislation. For documents subject to the Swiss ten-year retention obligation, the period runs from the end of the relevant financial year.
- Other contractual data: for as long as is necessary to perform the relationship and, thereafter, for mandatory obligations or the protection of rights, limited to the data that is necessary.
- Technical server logs: up to 30 days, save for the retention strictly necessary to ascertain specific security incidents or to comply with legal obligations.
Any residual retention for legal obligations or for the protection of rights does not entail keeping the profile in the casting database for new opportunities.
8. Rights
Within the limits and under the conditions of the applicable legislation, you can request access to your data, its rectification, its erasure, the restriction of the processing and the handing over or portability of the data. You can also object to the processing for which such a right is provided.

We reply without undue delay, within the time limits laid down by the applicable legislation: normally one month for requests under the GDPR and 30 days for requests for access under Swiss law. We will inform you of any extensions or restrictions permitted by law.
Where the processing is based on consent, you can withdraw it at any time. For the casting database you can write to scouting@moimodels.com. Withdrawal does not affect the lawfulness of the processing carried out before the withdrawal.
You can report suspected infringements to the Federal Data Protection and Information Commissioner (FDPIC). Where the GDPR applies, you can lodge a complaint with the competent supervisory authority, in particular in the Member State where you habitually reside, where you work or where the alleged infringement took place.
9. Minors
We accept applications exclusively from persons who have reached the age of 16.
Applications from persons under 18 years of age require the authorisation and countersignature of a parent or legal representative.
Any booking involving a minor requires a specific written authorisation for the assignment concerned, without prejudice to any further requirements laid down by the applicable legislation.
The authorisation for the application does not replace the optional consent to the casting database, nor the authorisations required for the use of the image.
10. Updates and contact
We may update this policy in order to reflect changes in the processing activities or in the law. The updated version is published on this page with the relevant date. Where necessary, we will provide specific notice before starting new processing activities.
